Il mio padrone di casa di cui ho scritto in un post precedente è di nuovo una seccatura. Il riscaldamento nella mia stanza non funziona regolarmente e adesso fa davvero freddo. Devo davvero pagare per riparare il riscaldamento? Anche i miei coinquilini hanno detto che avevano dei problemi e lui non mi ha aiutato. Voglio dire, non deve occuparsi di nulla in casa?

    Landlord is trying to fuck you over. Its his/her responsibility to pay for fixing the heater. Broken heater in the wintertime constitutes an emergency btw, you should talk to the Mieterschutzbund about this they have good lawyers for members. If you are not a member yet, see that you become one asap.

    Sorry to hear that.

    But before you take any action (e.g. Mietminderung) check if there is air in the heater. If yes, remove it yourself. This is easy and should fix most of the issues. For example see this video: [https://www.youtube.com/watch?v=g190TQEMeJQ](https://www.youtube.com/watch?v=g190TQEMeJQ)

    If there isn’t any air in the heater contact the Mieterschutzbund. Maybe together with your roommate(s). No heating in winter is an emergency.

    Are you sure this is a landlord situation? This reads more like she’s the main tenant, subletting the room or apartment to you.

    Go to Mieterschutzbund or a lawyer. ASAP. It will get colder until end of January.

    The heating is part of the building / your flat, it is part of the rent and your landlord has to guarantee the correct functionality.

    Your landlord “hat den Knall nicht gehört”, as we say in German.

    Of course, it’s his duty, and he has to pay for that. There are things you have to pay yourself, heating is not among it.

    Mieterschutzbund/Mieterverein. Can’t say this often enough.

    Any foreign student should do this, the behavior of too many landlords towards foreign students are disgusting.

    Bezahlen müssen Mieter die Reparatur nur dann, wenn die Gegenstände durch den alltäglichen Gebrauch verschleißen. Heizung oder Rohre etwa zählen nicht dazu.     Depends on your Mietvertrag.
    Kleinreparaturen are normally payed by the tenant.

  14. “funktioniert sehr selten” and “ist zu kalt” are quite subjective descriptions.

    How does not working look like? How cold is “too cold”? Are you using it correctly (adjust the thermostat). Is it maybe just a small maintenance issue that could be resolved without making lawyers rich?

    If it’s indeed defective and can’t keep the required temperature it’s the landlords job to get it fixed, while you could reduce the rent until this is done. But for this you need hard facts, actual protocol of the temperatures etc to make your case.

    Tell her “Bitte lass die Heizung reparieren” – She will think you agree to her terms.

    Just let her call someone to repair. You wont have to pay anything, the invoice will go to your landlord, since it’s his order. If the repaiman sends the invoice to you just decline since your are in no contractoral agreement with him.

    Just dont sign anything.

    Nope, her responsibility.

    That said, I’d have a word with the hausmeister. Mine fixed my radiators twice without any fuss. And any bills will automatically be sent to her via the hausvervaltung.

    Of course Mieterverein is the way to go for that situations and all to come in the future.
    Besides that, sometimes you can fix your radiator yourself. You can twist the control thingy off and then you can see a little pin. With some pliers you can pull it out and push it in a couple of times and then it’s loose again. At least that was the solution for me many times

  21. First: you’re writing it’s a WG, so how’s the contractual situation? Do you have a shared contract (as roommates) with the landlord? Is one of you the “Hauptmieter” and the others have a sublease? Do all rommates have individual contracts with the landlord? This information is important to know, who’s in charge to contact whom.

    But regardless of the outcome of the previous paragraph:

    Find your local Mieterverein and become a member next week. (Use your zip code on this web page to find it: https://mieterbund.de/mieterverein-vor-ort/). Being a Mieterbund-Member is essential if you are living for rent.

    Make a consultation appointment about “Mietminderung auf Grund defekter Heizung”. As a new member, you wouldn’t get paid help by a lawyer (usually you have to wait for a couple of months before the Rechtsschutz kicks in) but the Mieterverein councelors do know Mietrecht pretty well and will give you a template for a letter to your landlord, which you’ll have to print on paper and send via mail.

    If it’s a radiator: Check for air in the radiator. Is it warm only on one side? Check the end opposite to the tubing. There should be an air release valve, often using a square key (you can get that key at your local hardware store) or a flat-Head screwdriver. Open the valve a little. Is water or air coming out? If air is coming out, release the air until water comes out. If nothing comes out, the pump of the heating system is off. That’s the landlord‘s problem to fix asap (and they need to pay for it). If cold water is coming out, the heating is damaged. Also, that is the landlords problem to fix. Contact your local Mieterschutzbund for help with how much rent you can withhold for that and how to announce this properly. If this isn’t done properly, you could be forced to pay the withheld money back or even evicted.

    have you bled the radiators? Its a pretty common cause for heating not working properly. If you search “heizung entlüften” on youtube you can find step by step instructions how to do it yourself. You just need an Entlüftungsschlüssel which you can pick up for a few cents at your local Baumarkt.

    You’ve bled them but its still not working it could also be a stuck valve which is also a pretty easy fix with a bit of googling.
