I don’t think it should. This is not safety-crucial element.
However I’d suggest bending the the part thats protruding, as this could be considered a hazard for others.

It most likely be noted but you won’t fail. Wheel arches are not that crucial. However, having this much of rust I would check sills as rusted out sills can fail your inspection

Any sharp edge sticking out beyond the car’s outline will theoretically cause the car to fail inspection. Chances are good that no one will complain, but I would put some kind of duck tape on it just to be on the safe side.

Just the fender shouldn’t make it fail, but it’s a sign to check what’s going on underneath. B6s rust incredibly fast (especially compared to old B5s, which seem to resist it a lot better)
